4 Things State Law Tends to Do

Require a Real Relationship

California is the clearest example: a mental-health professional must have had a client relationship for at least 30 days before writing ESA documentation, and must have completed a clinical evaluation. Several states have followed with similar rules.

Set Documentation Standards

States including Montana, Virginia, Florida and Iowa specify what a housing provider may request and what documentation must contain — usually license details and a statement of disability-related need.

Penalize Misrepresentation

Most states now penalize passing a pet off as a service animal, and a growing number penalize falsified ESA documentation. Penalties are typically fines or misdemeanour charges.

Extend Housing Coverage

Some state and local fair housing laws reach small owner-occupied buildings that the federal Act exempts. If federal law does not cover your building, your state law may.

Does My ESA Letter Work in Every State?

The Fair Housing Act applies nationwide, so the protection itself does. What changes state by state is who may write your letter and what a housing provider may ask for. Because the mental-health professional must hold a license in the state where you live, a letter written for you in one state does not automatically transfer when you move to another.

Which States Have Their Own ESA Rules on Top of Federal Law?

We currently track ESA-specific statutes in fifteen states, flagged in the directory above. They fall into four broad groups: states requiring an established clinical relationship, states setting standards for what documentation must contain, states penalizing misrepresentation, and states whose own fair housing law reaches buildings the federal Act exempts.

Which State Has the Strictest ESA Law?

California. Under Assembly Bill 468, in force since January 1, 2022, a mental-health professional may not issue ESA documentation unless they hold a valid license, have had a client relationship with you for at least 30 days, and have completed a clinical evaluation. In practice a genuine California letter is a two-appointment process spread over at least a month.

What Happens to My Letter if I Move to Another State?

Contact us before you sign the new lease. Because the letter should come from someone licensed where you live, a cross-state move usually means a short re-review with a mental-health professional licensed in the new state rather than a whole new screening. If you are moving to California, allow for the 30-day requirement.

Can a State Law Give Me More Protection than the Fair Housing Act?

Yes. Several state and local fair housing laws reach housing the federal Act exempts — small owner-occupied buildings, for instance. New York State's Human Rights Law and New York City's own ordinance are the clearest examples. If your building is too small for federal coverage, check the state and city rules before assuming you have no claim.

Do Any States Require an In-Person Appointment?

No state requires the evaluation to happen in person; telehealth is accepted practice throughout the United States. What some states do require is a genuine, established clinical relationship — which is a different thing from a face-to-face meeting, and the reason a same-day letter is not possible everywhere.

Is There a State Where ESA Registration Is Required?

No. No state operates or recognizes an emotional support animal registry, and no certificate, ID card, vest or database entry carries legal weight anywhere in the country. Several state attorneys general have taken action against websites selling them.

Which States Penalize Fake ESA Letters?

A growing number. Most states already penalize misrepresenting a pet as a trained service animal, and states including Florida, Arkansas, Iowa and Utah have added provisions covering falsified assistance animal documentation. Penalties are typically fines or misdemeanour charges.

Do State Laws Change What My Landlord Can Ask Me?

Sometimes. Florida and Virginia, for example, address explicitly what written documentation a housing provider may request. What no state permits is a demand for your diagnosis, your medical records, a fee for making the request, or proof that the animal has been trained.
